A person is considered to be a speeding driver if, by deliberately violating elementary traffic rules, he or she runs a high risk of causing an accident resulting in serious injury or death. This includes, for example, dangerous overtaking or an unauthorized race with motor vehicles.

A so-called speeding offense occurs when the prescribed speed is exceeded as follows:

There is even the threat of imprisonment
As a penalty for a speeding offense, the driver's license is revoked for at least two years. After that, the license will only be returned if a positive traffic psychology report can be presented.

In the event of a repeat offence, speeders must surrender their driver's license for good. And: There is a threat of between one and four years in prison. In the case of blatant speeding, the car can be confiscated and forfeited.

Soon change in speeding law
The minimum penalties for speeding offenses will probably not apply in this form for much longer. Parliament has instructed the Federal Council to give the courts more leeway again and to make speeding measures more proportionate. This is intended to avoid undesirable cases of hardship.

The courts should now examine the circumstances in each individual case and decide freely on the level of punishment. To this end, the law must be amended. The consultation on the amendments ended on December 12, 2020.

The feedback received will now be evaluated so that the Federal Council can subsequently submit a legislative message to parliament.

What is the cost of speeding?
According to federal recommendations, the fines for speeding and the tolerance margins for speed measurements are as follows (fines and measures may vary by canton):

A warning is issued for a minor violation of traffic regulations. It is a kind of "yellow card" and does not yet include a driver's license withdrawal. However, if you continue to violate the traffic rules in the following two years, you must expect more severe consequences.

Entry in the criminal record
Violations within the city of 25 km/h, outside the city of 30 km/h and on the highway of 35 km/h are entered in the criminal record and are recorded in the criminal record for a certain period of time.

In the event of a reprimand, the driver's license will be revoked for at least one month. In the event of a repeat offense, the duration of the driver's license revocation will be significantly increased.
